When you take a decision to buy a property in Turkey, you have to make a study about the real estate market in Turkey. One of the most important points to focus on well is to know the types of title deed in Turkey, that document that shows ownership and guarantees the legal right of the owner of apartments in Turkey.
There are several types of title deeds in Turkey:
easement deed:
The property is registered with an easement deed when a property is purchased in Turkey as part of a project under construction.
The easement deed is the title deed in which each section of the property is registered separately. In other words, when the construction company plans the project and lays out the plan to build on the plot of land, and gets approval for construction the project is divided into sections (number of apartments within the building), and each apartment is organized with a special document showing the location and area of the apartment and the information about it.
The type of property is included in such bonds (construction land) because the construction work has not been completed. When the construction work is completed and the property is ready to move in, the owner is given the title deed.
The title deed:
When you buy a property in Turkey in ready to move project, you are given a full title deed in Turkey of your apartment that proves your ownership of the apartment and preserves your legal right.
The full specifications of the property are mentioned in the title deed “Tabu” in terms of the area of the property, its commercial or residential type, and others.
It should be noted that the land registry of the apartment should be disclosed before purchasing, in order to find out whether the property is subject to restrictions such as seizure or foreclosure.
The Land Registry Department must also be reviewed for detection and inquiries, because the restrictions, if any, are not mentioned in the title deed.
What is the difference between title deed and court ruling?
The origin of property ownership is that the property is registered in the land registry and is sorted, this is called the title deed.
In some buildings, cases of violations of the basic report are recorded, for example, one or more floors are added to it, or the basic report is land intended for construction only, and shops, homes and more floors are built without licenses and in violation of standards.
When these violating floors are sold, they are sold as they are, and the property remains registered in the real estate registry as land intended for construction only.
While on the ground, a building is actually built, and therefore it is not possible to obtain a legal title deed for the new property owner to establish his rights.
In this case, both the seller and the buyer go to the judgment of the court.

Notary Public Document:
The title deed in Turkey registered with the notary public is a legal document, and the property is registered with the notary when the purchase is in installments. After the full payments are made by the owner of the apartment, it is registered in his name in the Land Registry and he obtains the title deed.
The construction companies resort to registering the property with the notary public in order to guarantee their legal rights and the right of the buyer.
It is worth noting, that every region has its own notary center and each state has a department, and all notary centers in the city are affiliated to it.
What are the modifications made to the title deed registration system in Turkey?
The Turkish government has made a package of amendments to the title deed in Turkey registration system , including:
– Granting a separate identity with a special number for each title deed
– Mention the total area and net area of the building in the title deed
– Implementing the “Business Intelligence” system, which enables the Ministry to monitor transactions accurately and allows the owner to inquire about his property by sending an SMS
– Activating the real estate appraisal system to control the real value of the property.
